Terms and Conditions

1. Introduction and Acceptance of Terms

These Terms and Conditions ("Terms") govern your access to and use of the EnergyCloud platform ("Platform"), operated by Terawatt Energy (Pty) Ltd ("Company", "we", "us", or "our"), a company registered in the Republic of South Africa.

By accessing or using the Platform, uploading an electricity bill, creating an account, or making a payment, you ("User", "you", or "your") agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Platform.

We reserve the right to update or modify these Terms at any time. Continued use of the Platform after any changes constitutes acceptance of the revised Terms. We will notify registered users of material changes via email.

2. Service Description

EnergyCloud provides an AI-powered electricity bill analysis service that:

1. Analyses your electricity bill and consumption patterns using artificial intelligence.
2. Compares your current tariff against available alternatives from Eskom and municipal providers across South Africa.
3. Generates a comprehensive savings report identifying potential cost reduction opportunities.
4. Provides energy efficiency recommendations tailored to your usage profile.

3. User Obligations

As a user of the Platform, you agree to:

1. Provide accurate, current, and complete information when creating an account or uploading electricity bills.
2. Upload only authentic electricity bills that belong to you or for which you have authorisation to submit.
3. Maintain the confidentiality of your account credentials and not share your login details with third parties.
4. Not use the Platform for any unlawful purpose or in violation of any applicable South African legislation.
5. Not attempt to reverse-engineer, decompile, or interfere with the Platform's functionality or security measures.
6. Ensure that all information provided is truthful and not misleading.

4. Payment Terms

1. Each electricity bill analysis report costs R99 per report.
2. Payments are processed securely via PayFast, a licensed South African payment gateway.
3. All prices are quoted in South African Rand (ZAR).
4. Payment must be completed before the full analysis report is delivered.
5. Once a report has been generated and delivered, no refund will be issued, except as set out in clause 4.6 below.
6. Money-Back Guarantee: If our analysis determines that no savings opportunities exist for your current tariff arrangement, you are entitled to a full refund of the R99 fee. To claim this refund, contact us at info@energycloud.co.za within 14 days of receiving your report.
7. We do not store your payment card details. All payment processing is handled by PayFast in compliance with PCI-DSS standards.

5. Intellectual Property

All content, features, functionality, software, designs, text, graphics, logos, and trademarks displayed on the Platform are the exclusive property of Terawatt Energy (Pty) Ltd or its licensors and are protected by South African intellectual property laws.

The analysis reports generated for you are licensed for your personal or internal business use only. You may not reproduce, distribute, sell, or commercially exploit any report or content from the Platform without our prior written consent.

6. Data Handling and Privacy

Your privacy is important to us. The collection, use, storage, and protection of your personal information is governed by our Privacy Policy, which forms an integral part of these Terms.

By using the Platform, you consent to the collection and processing of your personal information as described in the Privacy Policy, in compliance with POPIA.

7. Limitation of Liability

1. The savings estimates and recommendations provided are advisory in nature and are not guaranteed. Actual savings may vary.
2. EnergyCloud shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.
3. We do not warrant that the Platform will be uninterrupted or error-free.
4. Our total liability shall not exceed the amount you paid for the specific report giving rise to the claim.

8. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the courts of the Republic of South Africa.
